A Missouri law effective August 28, 2009 requires all businesses to provide notice if a security breach compromises the confidentiality of personal information they maintain on Missouri residents.

Who Must Comply?

Missouri’s data breach notification law applies to two classes of businesses:
1. Any person or entity that retains personal information on Missouri residents as part of its internal customer accounts, or for the purpose of conducting transactions with the individuals (“data owners”).
2. Any person or entity that maintains or possesses personal information on Missouri residents on behalf of a data owner (“service providers”).

Just When You Thought It Was Safe…

Missouri and Illinois Tort Reform Update

In the past 10 years, numerous states have enacted legislation aimed at curbing huge verdicts in medical malpractice cases and ensuring some stability in the medical profession.  The states in which we practice, Illinois and Missouri, have both enacted tort reform statutes.  Common themes found in statutes for both Missouri and Illinois are:

  • non-economic damage caps,
  • review from a qualified expert prior to or closely following the filing of a lawsuit, and
  • provisions to prevent venue shopping.

Unfortunately, the supreme courts in many states, including Illinois, are striking down the medical malpractice reform statutes as unconstitutional.

Three Key Remedies for Insurance Disputes

Businesses buy insurance to avoid losses from many risks.  Policies can be purchased to insure against such risks as natural disasters, employee theft, clouded title to real estate, and fire losses.  If a covered event happens, the insured is paid for the loss.  Amounts recoverable may include the cost of repair or replacement of damaged building or equipment, and possibly lost profits. Such insurance policies, which reimburse the insured for direct losses incurred, are called “first-party” policies.

There are also “liability” policies, by which the insurer protects an insured against liability claims by injured parties.  In effect, the insurance pays amounts the insured would otherwise have to pay for damage claims.  The insurer also often pays litigation costs and attorney fees.

Meet Liz Grana

Elizabeth “Liz” Grana joined Behr, McCarter & Potter, P.C. as an attorney in August 2009 following graduation from Saint Louis University (SLU) School of Law.  Grana had served as an intern at the firm during summer 2008 and previously gained experience as a legal intern for the Hon. E. Richard Webber of the U.S. District Court, Eastern District of Missouri.  She also completed an internship with the U.S. Attorney’s Office, Eastern District of Missouri, Violent Crimes Division.

A native St. Louisan, Grana earned a B.A. in political science, journalism, and business administration in 2006 from Knox College (cum laude), where she was senior class president and set several school records on the women’s basketball team.  She graduated from Cor Jesu High School in St. Louis.

While in law school, she won the Judge Robert G. Dowd Sr. Award for Appellate Advocacy.  She also was a member of SLU’s Trial Advocacy Team and National Moot Court Team, which won First Place in its regional competition.

University of Missouri and Mizzou Alumni Honor McCarter with 2009 Distinguished Service Award

W. Dudley McCarter was honored in early October 2009 with the 54th annual Distinguished Service Award by the University of Missouri (MU) and Mizzou Alumni Association in Columbia, Mo.  Established in 1956, the award is the highest honor presented to alumni of the university.  It recognizes outstanding service by an individual whose efforts expand the university’s excellence.

A 1975 graduate of the MU School of Law, McCarter has distinguished himself in the practice of civil litigation, construction law and municipal law as a principal at Behr, McCarter & Potter, P.C.
